Owners given access

The Conder Owners Corporation (OC) has granted facility temporary access to owners who mounted VCAT action due to the introduction of induction procedures.

The Conder OC made pool and gym induction mandatory in February this year, with anyone who had not completed the induction being denied access to the facilities.

Peter and Lyn Kelly, who operate Docklands Private Collection of Apartments, own an apartment in the building and launched VCAT action privately on grounds of being denied their rights as owners when they were prevented from using the facilities.

Metro Real Estate had also launched VCAT action against the OC.

Metro Real Estate trades as Grand Mercure Docklands, a MAB Corporation serviced apartment business that operates out of the Conder.  

At a VCAT directions hearing on May 2, it was decided that both matters would be heard together.

The Conder OC also submitted at the hearing that access to the facilities would be granted to the parties until a decision was reached.

A VCAT compulsory conference was scheduled for July 19 to determine if settlement could be reached.
