Legal action on hold

A group of NewQuay owners have put legal action against their own owners’ corporation (OC) on hold, pending an upcoming annual general meeting (AGM).

The owners, from Boyd, Palliadio and Sant’Elia, had intended to launch legal action after their OC committee nominations were allegedly rejected by a sub-committee comprising members of the existing OC.

A number of residents who submitted OC committee nominations received a letter from Boutique Property Management, on behalf of the OC, advising that a nominations sub-committee had found “there were other candidates who met the criteria more fully.”

Resident John Kakos says the group now understands all nominations will be considered at the May 4 AGM.

Mr Kakos said the group reserved the right to take legal action depending on what happens at the meeting.

Consumer Affairs says OCs do not have the authority to veto nominations.
