Court action likely over Serrata

Property owners and Lend Lease could be heading for the courts over residents’ claims they were misled when they bought into the Montage and Mosaic developments.

Resident Frank Ruggio said the possible court action was designed to pressure Lend Lease into modifying its plans for the 15-storey Serrata development in Bourke St.

He said prior to purchasing, Lend Lease told Montage and Mosaic owners that the Seratta site was earmarked for a low-rise community purpose building such as a library or community centre.

Mr Ruggio said the action against Lend Lease could be taken in the Supreme or Federal Courts, depending on whether the particular owners were individuals or companies.

“We’re not really looking for compensation,” he said. “We just want what we were promised in the first place.”

Residents were due to decide their course of action at a meeting on June 3.  

Lend Lease declined to discuss the matter with Docklands News.
